Decision Delayed on LAPD Impoundment Proposal
The decision for LAPD Chief Charlie Beck’s proposal to change current vehicle impounding policy for unlicensed drivers will now be revealed on February 28.
The Police Commission was expected to make a decision on the proposal in a meeting Tuesday, but Commission President Richard Drooyan said it needed further legal advice from the City Attorney’s Office.
Current law states that vehicles of unlicensed drivers will be impounded for 30 days, which can cost more than $1,000. Beck calls this law too harsh.
His proposal would allow unlicensed drivers’ vehicles to be impounded shorter than the current 30-day period as long as they have proof of insurance, government-issued identification, and no prior convictions. They will still be cited. The proposal will only apply to first-time offenders.
The Legislative Counsel Bureau declared the proposal illegal on Saturday.
“A local government does not have the authority to establish a policy authorizing the release of an impounded vehicle driven by a driver who has never been issued a drivers’ license and who does not have a prior conviction for driving without a valid driver’s license prior to the end of a 30-day impound period,” said William Chan of the Legislative Counsel Bureau.
The Police Commission wants to pass the proposal to give a clearer understanding of when to impound and which law to cite. They also feel the proposal would eliminate bias.
“A person in Chatsworth who is stopped, who’s unlicensed, can expect the same treatment and consequence for their actions as a person in San Pedro, or East L.A., or downtown Los Angeles, regardless of what time of day it is or what day of the week it is,” said Assistant Chief Michel Moore.
